Overall Objective: "The overall objective of the project of which this contract will be a part is as follows: A detailed strategy, which includes timetable of all legislative and administrative measures in order to comply with the "Right of Establishment and Freedom to Provide Services" acquis, is presented by Turkey to the European Commission.

Specific Objective: The purpose of the project of which this contract will be a part is as follows: A comprehensive action plan which clearly identifies all necessary legislative and administrative measures in order to comply with the “Right of Establishment and Freedom to Provide Services" acquis is submitted to the Chief Negotiator of Turkey.

Result Areas of the Project

Result 1

  • This result area aims at developing an action plan, including the relevant draft law, for complying the legal and administrative practices in Turkey with of the ones addressed in the Services Directive. In this context, the Consultant will determine and analyse all the service activities and related national legislation falling in the scope of the Services Directive. Following the identification of gaps between the EU and Turkish legislation, a horizontal law regulating the main principles of service provision and brining in administrative simplification will be prepared. In this scope, an action plan will be prepared for the establishment of Point(s) of Single Contact in Turkey. 
  • The developed Action Plan will benefit from the prior needs analysis to be conducted by the Consultant touching upon the institutional and human resources capacity of the stakeholders, technical assistance, technology and investment needs entailed for the implementation of the action plan.

Result 2

  • This result area will, in general, serve for the preparation of an action plan, including the relevant draft law, for setting-up of a properly functioning recognition of professional qualifications system. Within this framework, the Consultant will prepare an inventory of regulated professions along with the design of a roadmap for regulation of unregulated professions in Turkey. Furthermore, the Consultant will scrutinise the national legislation and administrative framework for the purpose of identification of the gaps vis-à-vis the EU legislation. In line with the identified the gaps, the Consultant will prepare an action plan addressing the needs to be met in aligning with the EU Acquis, which will incorporate a specific action plan for designation of the National Contact Point. This result area also incorporates the development of the draft “Regulation and Recognition of Professional Qualifications Law”.
  • The developed Action Plan will benefit from the prior needs analysis to be conducted by the Consultant touching upon the institutional and human resources capacity of the stakeholders, technical assistance, technology and investment needs entailed for the implementation of the action plan.
